These Terms of Service govern your use of metropolitanhost.com and any services you purchase from MetropolitanHost. By placing an order or using our site, you agree to these Terms.

1. Who We Are

MetropolitanHost is a Brooklyn, New York-based studio. We sell premium WordPress templates on ThemeForest and directly through this site, along with done-for-you website packages, monthly maintenance plans, custom theme design, and one-off WordPress services.

2. Your Account

You may need to create an account to place an order. You’re responsible for keeping your credentials secure and for all activity under your account. Notify us immediately if you suspect unauthorized access.

3. Orders & Payment

  • All prices are listed in US dollars and are exclusive of applicable taxes.
  • Payment is taken at checkout via Stripe or PayPal.
  • Monthly maintenance plans are charged on a recurring basis until cancelled; annual billing is charged once per 12-month term with a 20% discount.
  • You’re responsible for ensuring your payment details are current. Failed charges on recurring plans may result in temporary suspension of service.

4. Templates & Licensing

WordPress and HTML templates purchased through ThemeForest are licensed under Envato’s Standard or Extended License, whichever you selected at purchase. Templates purchased directly from metropolitanhost.com are licensed under equivalent terms — contact us if you need the full text.

5. Service Delivery

  • Template Customization Packages ($899–$2,499) ship in 14 days or less, measured from the date we receive your kickoff brief and site access. If we miss this deadline for reasons within our control, you’re entitled to a refund per our Refund Policy.
  • Custom Branded Design Packages ($5,000–$15,000) ship in 4–8 weeks depending on scope, agreed in writing before project start.
  • Monthly Maintenance Plans deliver updates, backups, security, and performance checks on the rhythm described on our maintenance page. First audit runs within 24 hours of checkout.
  • One-off Services deliver within the turnaround listed on each service page, plus a 14-day free fix window after handoff.

6. Your Responsibilities

  • Provide timely, accurate content and access credentials when requested.
  • Respond to our questions within a reasonable window. Delays caused by late responses don’t count against our delivery guarantees.
  • Maintain your own backups of content you provide. While we take backups as part of maintenance plans, we can’t guarantee recovery of content you send us outside those plans.

7. Intellectual Property

Templates, documentation, and source code we sell or build for you are licensed, not sold, except where explicitly stated. After final payment on custom design packages, you own the final delivered site (code, content, and assets) for use on the one project we built it for. Our internal tooling, generic components, and pre-existing IP remain ours.

8. Acceptable Use

You agree not to use our site or services to:

  • Violate any law or the rights of others.
  • Attempt to gain unauthorized access to our systems or other customers’ data.
  • Send spam, malware, or fraudulent content.
  • Resell our work as your own or remove attribution where required by license.

9. Disclaimers

Our services are provided “as is” and “as available.” We don’t warrant that the site or services will be uninterrupted, error-free, or that any third-party plugin, integration, or service we configure will be free of defects or remain supported indefinitely.

10. Limitation of Liability

To the maximum extent permitted by law, MetropolitanHost’s total liability for any claim arising from these Terms or your use of our services is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages.

11. Termination

Either party may cancel a monthly maintenance plan at any time — see our Refund Policy. We may terminate your account if you materially breach these Terms; you may close your account by emailing us.

12. Governing Law

These Terms are governed by the laws of the State of New York, USA, without regard to conflict-of-laws principles. Any dispute will be resolved in the courts located in New York County, New York.

13. Changes

We may update these Terms from time to time. We’ll revise the “Last updated” date above and, for material changes, notify active customers by email at least 14 days before they take effect.
